Why should I get a trade mark?

To own and protect it! Having a registered trade mark gives you exclusive rights to use it, and stop others from copying you. It also stops others from trademarking the same or similar brand.

How much is it to get a trade mark?

Getting a trade mark starts at $670 on our TM Shop.

If I get a trade mark, am I protected internationally?

You get trade mark protection in the countries that you have a trade mark registration. This means you have to apply in each country you wish to be protected in. Get in touch for a chat about international trade mark registration.

If I get a trade mark, does that mean no one else can use it?

Yes, but only in relation to products and services that you have your trade mark registered, so make sure you are registered in all the classes that are relevant to your business.

When should I apply for a trade mark?

ASAP! Trade mark rights are on a first-to-file priority basis. If a competitor files an application before you, they’ve got dibs!

How long can I own my trade mark?

In Australia and New Zealand and most other countries, your trade mark is registered for an initial 10 years, and renewable indefinitely every 10 years thereafter. Literally decades! 

Can I trade mark my idea or invention?

Not quite! But if you have named or branded your idea or invention, you should definitely apply to register these as trade marks. Here’s a simple example: wireless earphones is an idea/invention, while ‘AirPods’, ‘Apple’ and the Apple Logo are trade marks.

What are ‘classes’?

Classes are categories of descriptions of the products or services you intend to use your trade mark on. When applying for a trade mark, you have to designate classes out of the 45 different classes your products or services may fall under.
